New Epic Universe Coaster “Starfall Racers” Faces Legal Hurdle Over Name

The Starfall Educational Foundation, a non-profit organization dedicated to early childhood education, has filed a lawsuit against Universal City Studios LLC, NBCUniversal Media, LLC, and Universal Studios LLC alleging trademark infringement over the name of their new Epic Universe roller coaster, “Starfall Racers.”

Starfall Racers, a dual-launch coaster set to debut next year at the opening of Universal’s Epic Universe, is described by Universal Studios as “a race across the cosmos…reaching incredible speeds up to 62 mph.” However, the Starfall Education Foundation claims that the use of the name “Starfall Racers” infringes on their well-established trademarks, which have been in use since 1999 and are widely recognized in the field of early childhood education.

According to the complaint, Universal Studio’s use of the name is likely to cause confusion among consumers, who may mistakenly believe that the roller coaster is associated with or endorsed by the foundation. This confusion could damage Starfall’s reputation and brand value, making it more difficult to raise funds for its educational programs, which have benefited millions of children worldwide. Additionally, the foundation argues that the use of its name in association with a thrill ride could dilute the distinctiveness of its brand, further diminishing its ability to effectively promote its educational mission.

The Starfall Education Foundation is seeking a court order to prohibit Universal Studios from using any of its trademarked names. The foundation is also seeking monetary damages and reimbursement for all attorney fees and costs. The initial complaint was filed on May 6, 2024.

Universal Studios has yet to respond to the lawsuit. The case is still in its early stages, and it remains to be seen how the court will rule. However, the outcome could have significant implications for both organizations, as well as for the future of intellectual property rights in the entertainment industry.
